I want to make sure I go above and beyond your expectations. One of the best ways I can achieve this is to get to know you and learn what expectations you may have ahead of time! I have put together some questions to help me (and you) prepare. For example, health issues, any restrictions, health issues that could be affected by our session (for example: walking long distances at location) etc* If kiddos are present, I believe sugary bribery works best with kiddos (kiddos who are age appropriate of course) and its always great to reward them for all their hard earned work. Is that ok with you? Is there any allergies I need to be aware of?* Section Break You will be now signing the agreement portion of the website. It is required in order to book your session. Retainer and Payment: Client shall reserve the time and date of services by signing and returning this contract along with a non-refundable, non-transferable reservation retainer of $50. No date is reserved until the contract and retainer are received. In the event Client fails to remit payment as specified, the Photographer shall have the right to immediately terminate this Agreement with no further obligation, retain any monies already paid, and not attend this event. Returned checks will be assessed a $50 non-sufficient funds fee. Unless the contract is canceled, the retainer fee shall be applied to the photography fee total.* I Agree I Disagree Model Release: This contract serves as a model release giving the Photographer the irrevocable right to use the photographs in all forms and in all media and in all manners, without any restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. The Photographer can grant use of the images to third parties and all compensation for use and credit for the images remain the property of Jen Lyon Photography. Client waives any right to inspect or approve the photograph(s), finished version(s) incorporating the photograph(s), or the use to which it may be applied, including written copy that may be created and appear in connection therewith. This release is binding on the Client, their legal representatives, heirs, and assigns. This includes use on Jen Lyon Photography Facebook page and blog. I Agree I Disagree Copyright: All photographs taken by Jen Lyon Photography are her property, will remain her property and are protected by United States Copyright Laws (USC Title 17). Client hereby waives any claims for ownership, income, editorial control and use of the images. Violators of this federal law will be subject to its civil and criminal penalties.* I Agree I Disagree CULLING + EDITING: After the portrait session, each image is put through a careful selection process, where The Studio selects images that meet her high standards of quality. Images with eyes closed, unflattering poses, and duplicate images are removed permanently immediately after The Studio completes this culling process. CLIENT acknowledges that The Studio retains complete control over the culling and editing process. The Studio color corrects and does portrait editing on all delivered images Photoshop. The Studio also retains complete control over which images are delivered in color and which images are delivered in black and white. All images that are printed through The Studio are retouched in Adobe Photoshop at The Studio's complete discretion. During the retouching phase for images printed through The Studio, will retouch any mark that will not be present in two weeks (i.e., acne). Any additional client requested edits, including but not limited to, removal of scars or birthmarks, removal of persons or things, body shaping, head swaps, etc. shall be invoiced to client for $50 per hour and it will delay your session time frame for getting the gallery of photos.* I Agree I Disagree Digital Images: Within 4 weeks of your session you will receive an online gallery of your images. Upon receipt of the digital files for the images, Client accepts all responsibility for archiving and protecting the photographs. Edited images will be stored for 2 months from date of session and then purged. RAW images are deleted during culling the process of editing. Photographer does not permanently archive image files. Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to access images provided. It is Client's responsibility to make sure that digital files are copied to new media as required.* I Agree I Disagree FAILURE TO MAKE FINAL PAYMENT: Failure by CLIENT to make the final payment as scheduled one (1) day prior to the portrait session shall be deemed a material breach of this agreement. in the event of a material breach by CLIENT, The Studio may cancel this agreement and be relieved from any further obligation of performance. The Studio may charge a $10.00 (USD) per day late fee on CLIENT final balance until the balance is paid in full. If the balance is not paid after 30 days, The Studio may send CLIENT account to collections. Until the final payment and all associated late fees are received by The Studio, all images, prints, and products from the portrait session shall remain the property of The Studio and shall not be released to CLIENT.* I Agree I Disagree Reproduction: If high resolution digital files are given in the gallery, a uploaded written PRINT release will be supplied with those files. The release grants Client the right to reproduce the images provided for their personal use only and does not allow the photos to be altered, sold or published. Client further agrees not to supply images to any third parties. The images that are being provided to you are licensed to you for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature.* I Agree I Disagree DAMAGE TO PHOTOGRAPHERS EQUIPTMENT: Any damage done to any photographers equipment by any members of CLIENTS session are liable for payment for replacement. Also any props or newborn props brought to clients home are also liable of client if damaged by a member in the session. (To refrain from this happening, please keep young children off the props unless given permission by photographer.* I Agree I Disagree LATE ARRIVAL: CLIENT acknowledges that he/she must arrive on time to her scheduled portrait session start time. If CLIENT is late to her scheduled start time, time will not be extended. If late the session will only be rescheduled for a later date if there is sessions available. Refunds are not available for portrait sessions cut short or entirely missed due to CLIENT'S late arrival. You will be able to schedule a session at a later time and the session funds amount will be transferred and used then.* I Agree I Disagree Liability Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.* I Agree I Disagree Due to the nature of custom photography, all sales are final* I Agree I Disagree Session requests made by the photographer.* *No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer *Please do not bring any children or adults not being photographed to the session.
